EU Says ‘Freemiums’ Can No Longer be Called ‘Free’

What’s the News?

Apple Inc. and other leading technology companies have reached an agreement with the European Union (EU) regarding their use of the word “free” in relation to mobile applications. The EU alleged that the companies were labeling apps as “free” in contexts that were likely to mislead consumers. By entering into the agreement, the companies each avoided the possibility of $5.65 million in fines.

The Better Business Bureau’s Online Interest-Based Advertising Accountability Program (Accountability Program) recently challenged Best Buy, Yelp, Answers Corp., Buzzfeed Inc., and Go.com over the companies’ failure to provide adequate notice regarding the fact that information was collected from their sites for online behavioral advertising (OBA) purposes. This marks the first cases issued as part of the Accountability Program’s promised Compliance Warning review.

Mailin’ It In: The FTC Gives the Mail Order Rule a Makeover

The News

The Federal Trade Commission (FTC) recently announced changes to the “Mail or Telephone Order Merchandise” Rule (a.k.a., the Mail Order Rule) aimed at updating the Rule for the 21st century and easing the costs of compliance. The Rule also got a new name and will now be known as the “Mail, Internet, or Telephone Order Merchandise” Rule. The changes will take effect on December 8, 2014.

ADT Home Security Settles Charges Over Deceptive Advertising

What Made News?

The FTC is cracking down on misleading endorsements in advertising, and the home security company ADT has the lumps to prove it. Earlier this month, ADT settled FTC charges that it had deceived consumers by failing to disclose that “independent” security experts were in fact paid ADT spokespeople.

FTC Warns Cole Haan Over Pinterest Contest

What Made News?

In a recent letter, the Federal Trade Commission (FTC) alleged that a promotional contest on Pinterest violated Section 5 of the FTC Act. Although the FTC did not take any direct enforcement action against Cole Haan, the letter forced Cole Haan to discontinue the contest and is one of the first instances in which the FTC has offered an opinion about what it takes to keep social media contests and promotions on the right side of federal advertising laws.

CDA Provides Safe Harbor for Internet Service Providers, Leaves Businesses Up the Creek

Recent court decisions suggest that federal law may limit businesses’ legal options to hold an internet service provider liable for harmful or damaging content posted to the Web. Under the Communications Decency Act (CDA) – a 1996 law aimed at regulating obscene and indecent internet content – an internet service provider cannot be treated as the “publisher or speaker of any information” provided by a third party content provider, even when the service provider makes the information available to the public.
